Enforcement of Right to Free Education and Article 25-A of the Constitution of Pakistan Report

Abstract

Presenting the findings of the Public Forum debate that highlights the plan for implementation of “Article 25-A” and devises strategies for designing a monitoring mechanism within the education sector of Pakistan. 

The purpose of this document is to present the findings of the public forum that was held in regards to the recent insertion of “Article 25-A” within The Constitution of Pakistan that guarantees the right to free and compulsory education for children of 5-16 years of age. Brainstorming session conducted among educationist, human rights activist and policy makers has resulted in several recommendations to be drafted that will allow successful enforcement of “Article 25-A” including the need to identify the role and responsibilities of the federal and provincial government within the implementation of legislation. The federal government should provide grants to areas that are under privileged whereas the provincial government must increase the education budget by 20% in order to achieve universal primary enrollment rate (MDG2).

A transparent and independent mechanism must be designed to monitor the enforcement of “Article 25-A” and a platform must be provided to facilitate various stakeholders to exchange information and express their views. Relevant authorities must expend effort to strengthen the capacity of public sector Education Departments while also encouraging participation from local community. A comprehensive strategy must be designed to achieve the objective of Article 25-A including the need to adopt formal and informal approaches of education along with teacher and vocational training. The discussion indicates that there is an imminent need to form a uniform education system that ensures quality, accessibility and equity within education.
